These terms cover CLAIV Echo (echo.claiv.io) and CLAIV Memory (claiv.io)

Introduction

Welcome to Claiv. These Terms of Service ("Terms") govern your access to and use of CLAIV Echo (echo.claiv.io) and CLAIV Memory (claiv.io), collectively the "Services", provided by Claiv ("we," "us," or "our").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICE.

1. Acceptance and Eligibility

By creating an account or using our Services, you agree to:

  • Be at least 16 years old (or the age of majority in your jurisdiction, whichever is higher)
  • Have the legal capacity to enter into a binding contract
  • Provide accurate and complete registration information
  • Not have been previously suspended or banned from the Service

2. Account Registration

2.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] of any unauthorised access or security breach.

2.2 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update it as necessary to keep it accurate.

3. Use of the Services

3.1 Permitted Use

You may use CLAIV Echo for lawful purposes in accordance with these Terms. You may use the canvas, chat, memory, and document features for personal or professional productivity, research, writing, and development activities.

3.2 Prohibited Conduct

You may not use the Services to:

  • Generate, store, or distribute illegal, harmful, hateful, or abusive content
  • Infringe on intellectual property rights of others
  • Attempt to reverse-engineer, disassemble, or access our systems without authorisation
  • Circumvent usage limits, authentication, or billing systems
  • Use automated scripts or bots to access the Services without express permission
  • Violate any applicable law or regulation
  • Harass, impersonate, or harm other users

4. Plans, Credits, and Billing

4.1 The Echo Plan

CLAIV Echo operates on a single plan — the Echo Plan — priced at £20/month. New accounts include a 7-day free trial with full access to all features. No credit card is required during the trial period.

4.2 Credit Allocation and Usage

The Echo Plan includes a monthly credit allocation. Credits are consumed on a model-weighted basis: lightweight models (such as DeepSeek V3 and Gemini Flash) consume fewer credits per message, while premium models (such as Claude Sonnet, Claude Opus, and GPT-5.4) consume more credits per message. Unused monthly credits do not roll over to the following month.

A trial account receives a limited credit allocation for the duration of the trial period. After the trial ends, access to premium models requires an active Echo Plan subscription.

Lightweight models (DeepSeek V3 and Gemini 2.5 Flash) remain available even when the monthly credit allocation is exhausted. Premium models are paused until the next billing cycle or until a credit top-up is purchased.

4.3 Credit Top-Ups

You may purchase additional credits at any time via one-time payments (£10 for 200 credits or £20 for 500 credits). Top-up credits do not expire and roll over into subsequent months. Top-up credits are consumed after the monthly allocation is exhausted.

4.4 Payments

The Echo Plan subscription is billed monthly via Stripe. By subscribing, you authorise recurring monthly charges of £20. You may cancel at any time; cancellation takes effect at the end of the current billing period. One-time top-up payments are non-recurring.

4.5 Fair Use

The Echo Plan is intended for individual personal or professional use. We reserve the right to apply fair-use limits or suspend accounts that exhibit usage patterns inconsistent with individual use, including automated or bulk usage without prior agreement.

4.6 Refunds

We offer refunds at our discretion. If you believe you are entitled to a refund, contact [email protected] within 14 days of the charge. One-time top-up payments are non-refundable once credits have been consumed.

5. AI-Generated Content

CLAIV Echo generates AI responses via third-party models (OpenAI, Anthropic, Google). AI-generated content may be inaccurate, incomplete, or outdated. You are responsible for verifying any AI output before acting on it, especially in professional, legal, medical, or financial contexts.

We do not claim ownership of AI-generated responses and make no warranties regarding their accuracy.

6. Memory and Your Data

CLAIV Echo extracts facts from your conversations and stores them in CLAIV Memory to provide personalised responses. You retain full ownership of your data. You can view, edit, and delete your memory at any time from Settings → Memory. Deleting your account removes all stored memory within 30 days.

7. Intellectual Property

The CLAIV Echo platform, including its design, branding, canvas system, and underlying memory infrastructure, is owned by Claiv and protected by intellectual property laws. You may not copy, reproduce, or distribute our platform without written permission.

Content you create using CLAIV Echo (your inputs, canvas content, documents) remains yours. You grant us a limited licence to process and store it solely to provide the Services.

8. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

9. Termination

You may terminate your account at any time from Settings → Account. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to use the Services ceases immediately.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
